1. Introduction


Welcome to Memery! Memery Inc. and its affiliate Memery Labs LLC (collectively, “Memery,” “we,” “us” or “our”) provide a social networking and gaming service through our mobile app and related website(s). We value your privacy and are committed to protecting your personal information.


This Privacy Policy explains what information we collect, how we use and share it, and your choices regarding your information when you use the Memery Service (the “Service”). By using the Service, you agree to the collection and use of information in accordance with this Privacy Policy. This Policy is incorporated into Memery’s Terms of Service as well as the Community Guidelines, and your use of the Service is subject to all documents. If you do not agree with our practices, please do not use the Service. If you have any questions, contact us at info@memery.fun.

2. Information We Collect


We collect several types of information from and about users of our Service. This includes:


Information You Provide


  • Account Registration Data: When you create a Memery account, we ask for your full name, username, full date of birth (used only to confirm you are at least 13), phone number, and a profile image or avatar, as well as associated communications to your account.

  • Date‑of‑Birth Gate Only: If the date of birth you enter shows you are under 13, the sign‑up process stops and we do not store any personal data.

  • Payout preference: Payout preference (bank transfer, PayPal, Venmo, or gift card) collected only when you claim a Contest prize.

  • User-Generated Content: We collect the content you create, upload, or post on Memery. This includes the photos, videos, text, comments, recordings, or other media that you create on the platform, as well as associated metadata (such as the time/date of creation, or location if you have location services enabled). Please remember that content you share may be seen by others based on your privacy settings, so do not include info you’re not comfortable being public.

  • Contacts (Optional): If you choose to find friends on Memery or invite friends, you may allow us to access your contacts on your device or link to a third-party account (like Facebook). In doing so, we may collect your contacts’ names, phone numbers, email addresses, or social media handles solely for the purpose of helping you connect with people you know. We will ask your permission before accessing your contacts, and you can decline. If you grant access, we store contact data only as needed to match you with existing friends on Memery and will not use it for other purposes without your consent. You should ensure you have your contacts’ consent before providing their information to us. You can unlink or remove contacts at any time in the app settings.


Information We Collect Automatically: When you use Memery, we automatically collect certain data about your device and usage of the Service. This includes:


  • Usage Data: We track how you interact with the Service – for example, the content you view or engage with (likes, comments, shares), the people you follow, the search queries you enter, and games you play or features you use. We also collect logs of certain actions (e.g., when you log in, when you report content, etc.) to help us understand usage patterns and improve the user experience.

  • Device and Technical Information: We receive data from the device and app you use. This may include your device model, operating system, unique device identifiers, app version, mobile network, IP address, time zone and language settings, and possibly device sensor information (like accelerometer or gyroscope data) if needed for a feature. We also collect device event information, such as crashes, error reports, and system activity, to maintain reliability and security.

  • Location Information: If you enable location services or geo-tagging in Memery, we may collect precise geolocation data from your device (GPS coordinates or similar). You can choose to share location (for example, tagging a post with your city or using location-based features) – this is voluntary. If you don’t enable location, we may still infer general location from IP address (which gives a rough regional location). You can control location access in your device settings at any time.

  • Cookies and Similar Tech (on our Website): Our public marketing site sets only first-party cookies for basic analytics; the iOS app itself uses no cookies, relying instead on the Amplitude and Branch.io SDKs described below.

  • Verification Metadata: Pass/fail timestamp, issuing country of ID document, and truncated ID number – retained solely to confirm eligibility and prevent fraud.


Note: We aim to limit the data we collect to what is relevant and necessary for providing our Service. We do not intentionally collect sensitive personal data (such as biometric identifiers, health info, or financial account details) through the app. Please avoid posting or revealing anything highly sensitive about yourself or others on the platform.


Information from Third Parties: We may obtain information about you from third-party sources in a few situations:


  • Linked Third-Party Accounts: If you choose to link or sign up via a third-party account, we receive information from that third party such as your profile name, user ID, friend list, or email, as permitted by that service and your privacy settings there. We use this to facilitate account creation, suggest friends, or personalize content.

  • Service Providers: We may receive information from service providers that help us with analytics (for example, aggregated statistics from Google Analytics or similar tools about how users navigate our app or site). These providers are contractually restricted in how they can use your data.

  • Others: If another user uploads content that includes you (for example, a photo of you or mentions you in a comment), we may collect that information as part of the user content on our Service. If a user invites you to Memery via our friend-finder feature, we may receive your email or phone number from them as part of the invite process.


3. How We Use Your Information


Memery uses the collected information for the following business and commercial purposes:


  • To Provide and Maintain the Service: We use data to operate the core functionality of Memery – allowing you to create an account, log in, create and share content, play games with others, and interact socially. For example, your username and profile info are used to identify you to other users, your content is stored and displayed per your settings, and your contact info (phone/email) might be used for authentication or to reach you with Service-related messages.

  • To Personalize Your Experience: We want Memery to be engaging. We may use your usage and profile information to recommend content or other users you might like, to populate your feed with relevant posts, and to infer preferences (e.g., if you often watch gaming clips, we might show you more of those). We might also use your data to customize in-app experiences. In some cases, we infer attributes like interests or (where allowed) gender from your activity to better personalize content. All personalization is aimed at improving content discovery and user satisfaction.

  • Communication: We use your contact information to send you service-related communications. This includes verifying your account or device, sending important alerts about your account or the Service (for instance, security notifications, changes to terms or policies), and responding to you when you contact us. If you opt-in, we might also send promotional messages such as updates about new features, newsletters, or special offers. You can opt out of marketing emails via the unsubscribe link, though you will still receive essential account communications.

  • Push notifications: You can disable app push notifications at any time via Profile ▸ Settings ▸ Notifications.

  • Analytics and Development: Internally, we analyze how users interact with Memery to troubleshoot issues, test features, and improve our Service. For example, we might track that a new feature is not being used much and decide to enhance it, or we might analyze aggregated gameplay data to balance our games better. We also use analytics to measure the effectiveness of outreach or understand user demographics in broad terms.

  • Safety and Security: Your information helps us maintain the safety, security, and integrity of Memery. We monitor activities and content to detect and prevent fraudulent transactions, spam, abuse, security incidents, and other harmful or illegal activities. If we notice odd login behavior (e.g., a login from a new location), we may use device or location info to verify it’s you. We also enforce our Terms and Community Guidelines by using data to investigate potential violations and take action (like removing content or banning users) when necessary. In some cases, automated systems may flag content for review (for example, detecting known child exploitation images via hashes, or extremist content), which helps us promptly remove bad content.

  • Legal Compliance and Enforcement: We may use personal data to comply with legal obligations, such as responding to lawful requests by public authorities, subpoenas or court orders, or to enforce our legal rights. For instance, we might retain certain information or share it with law enforcement when required by law or to protect our rights or the rights of others.


We will not use the personal information we collected for materially different, unrelated, or incompatible purposes without updating this Privacy Policy or obtaining your consent when required.


Security & Data Retention


Data are encrypted in transit (TLS 1.3) and at rest (AES-256). Employee access is role-based, and we conduct annual third-party penetration tests. We retain account data while the account is active. Back-ups are overwritten after 30 days. Media you delete is removed from production within 24 hours and from CDN caches within 7 days.


  • Security logs (sign‑in/device events): retained 13 months, then deleted or anonymized.

  • Analytics event data: retained up to 24 months, then irreversibly de‑identified.

  • Deleted media: removed from production within 24 h and from all backups within 30 days


Memery does not store identity-verification images, KYC information, or tax documentation. Such data, if required, is collected and retained exclusively by Tremendous Inc. and the selected payout provider.


Cookies & Similar Technologies


Because Memery is currently an iOS-only app, we do not set traditional web cookies. Instead, we rely on mobile SDKs and device identifiers:

  • Amplitude SDK – collects aggregated usage analytics (e.g., session length, screens viewed, feature taps) so we can understand how the product is used and improve it.

  • Branch.io SDK & universal links – captures install-referral data and in-app conversion events so we can measure the effectiveness of share links, influencer campaigns, and other marketing channels.


We do not serve third-party advertising or allow external ad networks to track you through the app.


Opt-out options:

  • You can reset or limit Apple’s Identifier for Advertisers (IDFA) in iOS Settings › Privacy & Security › Tracking.

  • You may also disable “Allow App to Track” for Memery to restrict cross-app attribution.

  • Deleting your Memery account in-app or emailing info@memery.fun will remove your analytics and attribution identifiers from our systems within 30 days.


4. How We Share Your Information


Memery is committed to respectful data practices and does not sell your personal information, nor do we share it for advertising purposes. We only share information in the following circumstances:


  • Service Providers (Processors): We share data with trusted third-party companies that perform services on our behalf. These include, for example:

    • Hosting and Infrastructure: (e.g., cloud storage providers, CDN networks) to store and deliver our app content and your data reliably.

    • Analytics Services: (e.g., analytics SDKs or platforms) to help us understand usage patterns.

    • Customer Support Tools: if you contact us for support, your info might go through a third-party support ticket system or email service.

    • Payouts: We share the minimum information necessary with Tremendous Inc. so that it can deliver your selected payout. Tremendous may in turn share that information with PayPal, Venmo, or your bank solely to complete the transaction. Memery does not receive or store any verification data or tax forms generated by those services.

    • Other Operational Partners: such as payment processors (if we ever facilitate purchases), or SMS providers (to send verification codes).

    • These service providers are contractually obligated to use your data only for the services we specify and to protect it. They cannot use or disclose your data for their own purposes.

  • Business Transfers: If Memery is involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be transferred as part of such a transaction. We would ensure the successor respects your personal information in line with this Policy (or give you notice and options if it will differ).

  • Legal Compliance and Protection: We may disclose information about you if we believe in good faith that such disclosure is necessary to: comply with any applicable law, regulation, legal process, or governmental request; enforce our Terms of Service or other agreements; investigate and defend ourselves against any third-party claims or allegations; protect against harm to the rights, property, or safety of Memery, our users, or the public as required or permitted by law. This could include responding to lawful subpoenas or emergency requests (for example, sharing data with law enforcement to prevent imminent harm).

  • With Your Consent: We may share your information for other purposes if you explicitly consent to it. For instance, if we want to feature your story or testimonial on our website, we’d ask your permission. Or if you opt in to a co-sponsored event or promotion, we might share limited data with the partner running it – but only with your knowledge.

  • Aggregated or De-Identified Data: We may also share information that has been aggregated (combined with other data so it no longer identifies you personally) or de-identified (stripped of personal identifiers). For example, we might publish trends or insights like “X% of Memery users love history memes” or provide analytics to business partners or the community. This information cannot be linked back to individual users and is not considered personal information.


5. Your Rights and Choices


We believe you should have control over your personal information. Depending on where you reside, you may have certain legal rights with respect to your data, and we provide ways for you to exercise those rights:


  • Access and Portability: You can request a copy of the personal information we hold about you, and to receive it in a portable format (to the extent required by law). For example, you might want to know what data we have associated with your account or obtain a backup of the content you’ve posted.

  • Correction (Rectification): If any of your information is inaccurate or incomplete, you have the right to ask us to correct it. Much of your basic profile info can be corrected directly in your account settings. For other data, you can contact us to request edits or updates.

  • Deletion: You can request that we delete your personal information. You can do this by deleting your account via the app settings; this will remove your profile and posts from view. We will also erase or anonymize personal data associated with your account unless we are required to retain it for legal reasons (e.g., records of transactions) or other exceptions under law. If you prefer, you may contact us to request deletion – we may need to verify your identity and will then proceed with deleting your account and data within a reasonable timeframe (normally within 30-45 days as required by law). Important: content that you shared with others (e.g., content that others have reposted) may still be visible to those users, and we do not control data that other users copied out of our Service.

  • Opt-Out of Tracking/Targeting: If we use cookies or similar tracking for analytics on our website, you can manage cookies via your browser settings or via any cookie consent tool we provide. In the app, if we ever decide to serve personalized advertisements based on your activity, we will provide you with an opportunity to opt out of targeted advertising (and for California residents, we would provide a “Do Not Sell or Share My Personal Information” option if applicable – presently, Memery does not sell or share data for targeted ads). You can also use device settings (like “Limit Ad Tracking” on iOS or “Opt out of Ads Personalization” on Android) to inform third-party ad networks that you don’t want targeted ads.

  • Communication Preferences: If you no longer wish to receive marketing emails or notifications from us, you can opt out. Use the “unsubscribe” link in promotional emails or adjust your notification preferences in the app settings. Transactional and service-related messages (like account verification, password resets, important notices) may still be sent, as these are not promotional.

  • California Privacy Rights: If you are a California resident, you have specific rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) regarding your personal information. These include the right to know what personal information we collect, use, disclose, and sell; the right to request deletion of your personal information; the right to opt-out of the sale or sharing of your personal information; and the right not to receive discriminatory treatment for exercising these rights. As noted, Memery does not sell personal data. California residents can exercise their access or deletion rights as described above (contact us at info@memery.fun with your request and verification information). Additionally, under California’s “Shine the Light” law, California users may request a list of third parties to whom we disclosed personal info for direct marketing in the past year; however, Memery does not disclose personal info to third parties for their own direct marketing.

      Because Memery operates entirely online, has annual gross revenues under $25 million, and does not sell or share personal information, California law (Cal. Civ. Code § 1798.130(a)(2)(B)) permits us to provide a single e-mail channel for privacy requests instead of a toll-free number.


  • Other U.S. State Privacy Rights: Residents of certain states (such as Virginia, Colorado, Connecticut, Utah, etc.) have similar rights to access, correct, delete, or opt-out of certain processing of personal data under those states’ laws. Memery will honor valid requests under those laws. For instance, Connecticut residents under 18 (or their parents, if under 16) may request account deletion – we provide the same deletion rights to all users, as described. If you are a resident of these states and have a request or appeal regarding your privacy rights, please contact us. We will respond within the timeframe required by applicable law.

  • GDPR (EEA/UK users): If you are in the European Economic Area, UK, or a similar jurisdiction with comprehensive data protection laws, you may have additional rights (e.g., right to restrict processing, right to object to processing, and right to lodge a complaint with a supervisory authority). Memery’s Service is currently primarily aimed at U.S. users; however, if GDPR or similar laws apply to us in the future, we will comply. Typically, we would process personal data only on lawful bases such as your consent (e.g., for optional data), to fulfill our contract with you (Terms of Service), or for our legitimate interests (to operate and improve the Service, prevent fraud, etc.), and we’d honor the exercise of European data subject rights. Exercising Your Rights: To make any request regarding your personal data (access, deletion, etc.), please contact us at info@memery.fun. We will need to verify your identity to ensure we’re providing data to the right person (for example, by having you send the request from the email associated with your account or by asking for certain information to match our records). For certain requests, we might ask for additional confirmation. We will respond to your request within the timeframe required by law (e.g., generally within 30-45 days). If we need more time or cannot fulfill your request (due to a legal exception), we will inform you of the reason and extension in writing. If you are unsatisfied with our response to a privacy request, you may have the right to appeal (particularly under some state laws); instructions will be provided in our response if applicable.


6. Data Security


We retain personal information for as long as needed to fulfill the purposes for which we collected it, unless a longer retention period is required or permitted by law. In general:


  • Account information and profile data are kept until you delete your account, or as long as your account remains active. If you simply stop using Memery, we may deactivate or delete your account after a prolonged period of inactivity, but we will try to warn you before doing so.

  • Content you post is retained and visible according to your settings (for example, content on an active account remains until you remove it or delete your account). If you delete content or your account, the content will be removed from active view, and we then follow our deletion process to remove it from our systems. This generally includes a short period in backups (to ensure it was not removed inadvertently) and then complete deletion. Note: content that was shared with or copied by others may persist in those users’ accounts or devices.

  • Other records, like logs of how you used the service, device information, and analytics data, are typically retained for internal purposes. We might retain logs and security-related data to improve and secure our Service (for example, to analyze trends, or if we suspect an account was misused, we keep records as evidence).

  • If required for legal obligations or legitimate business interests, we may retain certain information for longer. For example, we might retain data in response to a legal request, or account information of a user who was banned for harmful conduct to prevent them from rejoining, or backup copies for disaster recovery. When information is retained for longer, it will be appropriately isolated and protected.


When we no longer have a legitimate need to keep your personal information, we will dispose of it in a secure manner according to our data retention and deletion policies (e.g., by anonymizing the data or securely erasing it).


8. Children’s Privacy


Memery is not intended for children under the age of 13, and we do not knowingly collect personal information from anyone under 13.


Age Gate: During sign‑up we request a full date of birth solely to determine eligibility. If the date indicates the user is under 13, registration stops immediately and no personal information is stored. If we later learn that we have inadvertently collected personal information from a child under 13, we will delete that data—and, where feasible, the associated account—within a commercially reasonable period.


California Minors: If you are a registered user in California under age 18, you may request the removal of content or information you have publicly posted on the Service. To do so, please contact us at info@memery.fun with the subject line “California Removal Request” and a description of the content to be removed. We will make reasonable good-faith efforts to remove or anonymize the content from public view, though complete or comprehensive removal (e.g., if someone else re-posted your content) cannot be guaranteed as per California law. This removal right is not absolute – it does not apply to content that federal or state law requires us or a third party to maintain, that was stored or reposted by other users, or that we anonymize.

Connecticut Minors: If you are a Connecticut resident under age 18 (or a parent/guardian of a user under 16), you have the right to request deletion of the minor’s account or personal data. Please contact us at info@memery.fun with the request, including the username and associated email/phone of the account. We will delete the account and associated personal data, after reasonable verification, consistent with our deletion process and subject to any lawful retention requirements.


Contest Participation by Minors: Users aged 13-17 who participate in our Daily Meme Game Contest and win prizes (digital gift cards) will be required to confirm parental consent before prize redemption. We do not collect additional personal information from minor contest winners beyond what is necessary for basic account functionality.


We encourage parents and guardians to monitor their children’s online activities and to help enforce this Privacy Policy by instructing their children never to provide personal information without permission. If you are a parent or guardian and believe we have collected personal information from your child under 13 (or under 18 in certain jurisdictions) without proper consent, please contact us. We will investigate and take appropriate action.


9. International Users and Data Transfers


Memery is based in the United States, and our Service is primarily directed to users in the U.S. If you are using Memery from outside the U.S., be aware that your information will be transferred to and stored on servers in the United States or other jurisdictions where we or our service providers operate. Data protection laws in these jurisdictions may be different from those in your country of residence.


However, we take steps to ensure that your privacy is protected consistent with this Policy wherever your data is processed. If you are in a region with data transfer restrictions (such as the European Union), we will rely on legal mechanisms (for example, Standard Contractual Clauses or your consent) to transfer your data internationally. By using the Service or providing us with information, you consent to the transfer of your personal information to the U.S. and other countries, and the use and disclosure of information about you as described in this Privacy Policy.


10. Changes to This Privacy Policy


We may update or revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or other factors. If we make material changes, we will notify you by appropriate means, which may include posting the updated Policy on this page with a new “Last Updated” date, and/or providing a notice in the app or via email. Please review the Privacy Policy whenever we notify you of changes or periodically to stay informed of our data practices.


Your continued use of the Service after any changes to this Policy become effective constitutes your acceptance of the revised Policy. If you do not agree to the updated terms, you should stop using the Service and delete your account before the changes take effect.
